Terms and Conditions for SteakMaster

1. Acceptance of Terms

By downloading, accessing, or using the SteakMaster mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

2. Use of the App

SteakMaster is a tool designed to provide guidance and calculations for cooking. You are granted a non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use.

3. User Responsibility & Food Safety

You are solely responsible for ensuring proper food safety practices. Cooking times and temperatures provided by the App are estimates and can vary based on numerous factors. Always use a calibrated food thermometer to verify internal temperatures and follow local food safety guidelines (such as those from the USDA or your local health authority).

4. Disclaimer of Warranties

The App is provided "as is" and "as available" without any warranties of any kind, express or implied. SteakMaster does not warrant that the App will be error-free or that the guidance provided will result in perfectly cooked food or prevent foodborne illness.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • The developers of SteakMaster shall NOT be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenues, data, use, goodwill, or other intangible losses.
  • We are NOT liable for any damage to property, personal injury, foodborne illness, or any other harm arising from your use of the App.
  • Our total liability to you for all claims arising from or related to the App shall not exceed $50 USD or the amount you paid for the App (whichever is greater).
  • Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.

YOU ACKNOWLEDGE AND AGREE THAT YOU USE THIS APP AT YOUR OWN RISK.

6. Content Ownership

All content within the App, including text, graphics, logos, and software, is the property of the App's developers and is protected by copyright and other intellectual property laws.

7. Privacy

Our App collects minimal data as described in our Privacy Policy. By using the App, you consent to such data collection and use.

8. Modifications to Service

We reserve the right to modify or discontinue the App at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the App.

9. Intellectual Property

The cooking calculation formulas, algorithms, and methodologies used in this app are proprietary. You may not reverse engineer, decompile, or attempt to extract these formulas.

10. Updates and Changes

We may update the App periodically. These updates may include changes to features, formulas, or functionality. Your continued use of the App after updates constitutes acceptance of such changes.

11. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

12. Age Restrictions

This App is intended for users who are at least 13 years old. Users under 18 should use the App under adult supervision when cooking.

13. User Indemnification

You agree to indemnify, defend, and hold harmless SteakMaster, its developers, affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to:

  • Your use or misuse of the App
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Any food safety incidents, foodborne illness, or injuries resulting from your cooking activities
  • Your failure to follow proper food safety practices or local health guidelines

This indemnification obligation will survive termination of these Terms and your use of the App.

13A. Termination Rights

We reserve the right, at our sole discretion, to:

  • Suspend or terminate your access to the App at any time, with or without notice, for any reason, including but not limited to violation of these Terms
  • Modify or discontinue the App or any features thereof
  • Refuse service to anyone for any reason at any time

Upon termination, your license to use the App will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to: indemnification, limitation of liability, dispute resolution, and governing law.

13B. Force Majeure

SteakMaster shall not be liable for any failure or delay in performance of the App due to causes beyond our reasonable control, including but not limited to:

  • Acts of God, natural disasters, epidemics, pandemics
  • War, terrorism, civil unrest, government actions
  • Labor disputes, strikes, lockouts
  • Internet service provider failures, power outages
  • Third-party service failures (including Firebase, Google services)
  • Cyberattacks, hacking, malware

In the event of a force majeure, our obligations under these Terms will be suspended for the duration of the event.

13C. Export Compliance

The App may be subject to export control laws and regulations. You agree to comply with all applicable international and national laws that apply to the App, including U.S. Export Administration Regulations and economic sanctions regulations administered by the Office of Foreign Assets Control (OFAC).

You represent and warrant that you are not:

  • Located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country
  • Listed on any U.S. Government list of prohibited or restricted parties

13D. Entire Agreement

These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and SteakMaster regarding the use of the App and supersede all prior or contemporaneous understandings and agreements.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods shall not apply.

14.2 Mandatory Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Any dispute, controversy, or claim arising out of or relating to these Terms, the App, or any services provided (including any disputes about the validity, scope, or enforceability of this arbitration agreement) shall be resolved by binding arbitration rather than in court.

Arbitration Rules:

  • Administrator: International Chamber of Commerce (ICC)
  • Seat of Arbitration: Istanbul, Turkey
  • Language: English
  • Number of Arbitrators: One (1)
  • Governing Rules: ICC Arbitration Rules (current version)

Cost Allocation: The party initiating arbitration (the "Claimant") shall bear the initial ICC filing fees and administrative costs. The arbitrator may allocate costs between the parties as deemed appropriate under applicable law and the ICC Rules.

14.3 Class Action Waiver

YOU AND STEAKMASTER AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Unless both you and SteakMaster agree otherwise in writing, the arbitrator may not:

  • Consolidate more than one person's claims
  • Preside over any form of representative or class proceeding
  • Award relief to anyone other than the individual parties

14.4 Exceptions to Arbitration

Either party may bring an individual action in a court of competent jurisdiction for:

  • Injunctive or other equitable relief to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights
  • Claims that qualify for small claims court jurisdiction (if permitted by local law)

14.5 Opt-Out Right

You may opt out of this arbitration agreement within 30 days of first using the App by sending written notice to legal@steakmaster.app with the subject line "Arbitration Opt-Out" and including your name and a clear statement that you wish to opt out.

14.6 Severability

If any portion of this arbitration agreement is found to be unenforceable, the remainder shall remain in full force and effect. If the Class Action Waiver is found unenforceable, the entire arbitration agreement (but not the remainder of these Terms) shall be null and void.
